Rules for the Use of the Website and Provision of Services - DriveDataUK

1. General provisions

1.1. These terms (the “Rules”)define the conditions for using the DriveDataUK website and the services provided on it.

1.2. DriveDataUK is operated by DriveData UK Ltd.

1.3. By accessing or using DriveDataUK in any manner, you agree to these Rules. If you disagree with any part of the Rules, you are not permitted to use the website.

2. Definitions

Key terms used in these Rules include:

  • Report: A vehicle history report containing various types of information that DriveDataUK users can order.
  • Commercial User: An individual or entity using services primarily for business purposes.
  • Credits: Units in the user’s account that can be exchanged for Reports.
  • User: Anyone who orders a Report or uses the DriveDataUK website in any other way.
  • Account: The user account created on DriveDataUK to access services.
  • Services: The offerings provided by DriveDataUK, including the purchase of Reports or Credits.
  • Initial Report: Preliminary information provided after entering a vehicle’s VIN on the website.
  • Private User: An individual using the service for personal, non-commercial purposes.
  • Vehicle Identification Number (VIN): The unique 17-digit code assigned to each vehicle by its manufacturer.
  • Third-Party Websites: External websites not affiliated with DriveDataUK.

3. Account

3.1. To access certain services, such as managing Credits, users must create an Account. This can be done by:

  • Entering an email and password, and confirming the account via an activation link sent to the provided email.
  • Entering an email when purchasing Credits or a Report, and creating a password using a link sent by DriveDataUK.
  • Using third-party accounts like Facebook, Google, or Apple to create an Account.

3.2. Users are responsible for maintaining the confidentiality of their Account login details and for any activities carried out by third parties using their login information. Users should notify DriveDataUK immediately via email at help@drivedatauk.com if they suspect unauthorized use of their Account.

Users can delete their Account at any time by contacting DriveDataUK via email or through their Account settings.

4. Report

4.1. Users can purchase Credits that can be exchanged for a Report by entering the VIN on DriveDataUK. Credits will be added to the user’s Account within 60 minutes of payment.

4.2. The price of Credits may vary based on market conditions and other factors, but the current prices are always displayed on DriveDataUK.

4.3. Purchased Credits are valid for 6 months, after which they expire and are removed from the user’s Account.

4.4. Users can preview an Initial Report after entering the VIN. The full Report may not include all data categories indicated in the Initial Report if DriveDataUK is unable to find the necessary records.

4.5. The Report will be available in the user’s Account within 5 minutes of Credit deduction and will also be sent via email.

4.6. Reports are accessible online for 30 days, after which they will no longer be available unless downloaded in PDF format.

4.7. DriveDataUK strives to provide accurate information, but the content of the Report depends on the quality of public and third-party data sources, which are beyond DriveDataUK’s control.

4.8. Users are responsible for making informed decisions based on the Report and should verify critical information with relevant authorities.

4.9. Users may share the Report for evaluation purposes but are prohibited from reselling it.

5.User Responsibilities

5.1. Users must:

  • Not use automated tools to access, copy, or monitor the website or its content.
  • Not attempt unauthorized access to the website or its systems.
  • Not overload the website’s infrastructure or interfere with its operations.
  • Use the website only for lawful purposes and comply with the Rules.

6. Services

6.1. The service agreement between DriveDataUK and the user is effective upon payment.

6.2. Payment for services can be made via credit/debit card, bank transfer, PayPal, or cryptocurrency. Services are provided only after payment is received.

6.3. Users paying in cryptocurrency are responsible for ensuring compliance with relevant legal requirements.

6.4. DriveDataUK may offer promotional discounts, which are subject to specific conditions.

6.5. Pricing for services may vary by country based on market conditions.

7. Protection of Private Users

7.1. Private users can cancel their service agreement within 14 days by notifying DriveDataUK via email, provided they haven’t used any Credits. Refunds will be processed within 14 days of cancellation.

7.2. Users who exchange Credits for a Report waive their right to cancel due to the digital nature of the content.

8.Personal data protection

8.1. Information about how DriveDataUK processes personal data is available in their Privacy Policy. Users agree to the Privacy Policy by accepting these Rules.

9.Change or termination of Services

9.1. DriveDataUK reserves the right to change services or pricing. Users will be notified of significant changes at least 5 days in advance via email.

9.2. User access may be restricted or terminated if the Rules are violated.

9.3. Temporary service disruptions may occur for maintenance or due to force majeure events.

10. Liability

10.1. Users agree to indemnify DriveDataUK against any losses or damages arising from their use of the website or breach of the Rules.

10.2. DriveDataUK’s liability is limited to the extent permitted by law, particularly for factual inaccuracies in the Reports.

11. Intellectual property rights

11.1. All intellectual property on DriveDataUK, including the website’s design, content, and trademarks, belongs to DriveDataUK or its partners.

11.2. Users may not copy, reproduce, or distribute any content from DriveDataUK without express permission.

12. Applicable law and dispute resolution

12.1. The Rules are governed by the laws of the United Kingdom. Disputes will be resolved by negotiation or in a competent court.

12.2. Private users may seek redress through local consumer protection authorities if unsatisfied with DriveDataUK’s response to a complaint.

13. Information protection measures

13.1. Users are responsible for keeping their Account login information confidential.

13.2. While DriveDataUK strives to protect user data, it cannot guarantee the security of information transmitted over the internet.

14. Final provisions

14.1. These Rules constitute the entire agreement between the user and DriveDataUK.

14.2. If any part of these Rules is found to be invalid, the remaining provisions will continue in effect.

14.3. DriveDataUK may assign its rights under these Rules without user consent.
